Religiöse Anerkennung der Scientology Kirche in Spanien

Oktober 2007. Der spanische Nationale Verwaltungsgerichtshof entscheidet, dass die Scientology Kirche Spanien (IGLESIA DE SCIENTOLOGY DE ESPANA) vom Justizministerium als Religionsgemeinschaft in das Register für Religionen eingetragen werden muss. Diese Eintragung ist mittlerweile rechtskräftig erfolgt.

Die Kirche in Spanien teilte mit, dass die Stiftung für Pluralismus und Koexistenz dieses Jahr entschloss, in Folge der Anerkennung von Scientology durch das Nationalgericht im Oktober 2007, dem Justiz-Ministerium im Dezember 2007 und dem Finanzministerium im Dezember 2009, den Geburtstag von L. Ron Hubbard in seinem Kalender der Feiertage einzubeziehen.

Ministry of Justice: Registration in the Registry of Religious Entities

On the 12th December 2007, Mrs. General Director of Religious Affairs, in delegation of Mr. Minister of Justice, has accorded the following: …determined to grant the registration of the Religious Entity denominated “IGLESIA DE SCIENTOLOGY DE ESPAÑA”, domiciled in MADRID, C/Santa Catalina, nº 7, in the General Section of the Registry of Religious Entities created in the Ministry of Justice in conformation with that established in article 5 of the Organic Law 7/1980, of the 5th July, of Religious Freedom, and in the article 2, section A) of the Royal Decree of 9 January 1981, so as to guarantee the practice of their activities in conformation with the regulation established in the mentioned Law.

Audienca Nacional of Spain: National Church of Scientology of Spain should be entered in the Registry of Religious Entities

11.10.2007 The National Court thoroughly examined the Church’s formative documents and aims and purposes to unequivocally determine that the National Church of Scientology of Spain has the right to be registered as a religion under Spanish law.

In reaching this decision, the National Court also relied on decisions of the European Court of Human Rights, most notably the Human Rights Court’s unanimous decision of April 2007 affirming that the Church of Scientology is entitled to the rights and protections of religious freedom that flow to religious organizations pursuant to Article 9 of the European Human Rights Convention.

Spanish Constitutional Court rules Registration of Religions is a Right, Not a Privilege

The Spanish Constitutional Court’s 15th February 2001 decision is an extremely important and precedential pronouncement on minority religious freedom. Its findings that registration as a religious organization is an essential element of religious freedom, that all beliefs are protected by the “core right” to freedom of thought, conscience and religion, that states may not narrowly define religion to justify discrimination against non-traditional religions or belief systems, and that official actions to restrict the right to freedom of religion must be strictly scrutinized and justified by concrete and compelling reasons are extremely significant and should have substantial impact in the struggle for minority religious tolerance in Europe.

Spanisches Verfassungsgericht entscheidet, dass die Eintragung von Religionen ein Recht ist, nicht ein Privileg

Der Entscheid des spanischen Verfassungsgerichtes vom 15. Februar 2001 ist eine extrem wichtige und Präzedenz setzende Entscheidung zur Religionsfreiheit von Minoritäten. Sein Befund, dass die Eintragung als eine Religiöse Organisation ein wesentliches Element der Religionsfreiheit ist, dass alle Glauben vom „Kern-Recht“ auf Gedanken-, Gewissens- und Religionsfreiheit geschützt sind, dass Staaten Religion nicht in einem engen Bereich definieren dürfen um Diskriminierung gegen nicht-traditionelle Religionen oder Glaubenssysteme zu rechtfertigen, und dass offizielle Handlungen um das Recht auf Religionsfreiheit zu beschneiden strikt und eingehend zu prüfen und durch konkrete und zwingende Gründe zu rechtfertigen sind, sind extrem bedeutend und sollten einen maßgebenden Einfluss im Kampf für die religiöse Toleranz bezüglich Minderheiten in Europa haben.

La Inscripción de la Iglesia de Scientology de España en el Registro de Entidades Religiosas del Ministerio de Justicia, se hizo efectiva el 12 de diciembre de 2007, sin que el Ministerio de Justicia interpusiera la razonada sentencia de la Audiencia Nacional.
Audiencia Nacional: Entrada de la Iglesia de Scientology en el Registro de Entidades
Una sentencia de la Audiencia Nacional del 11 de Octubre de 2007, reconoció que: „La conclusión favorable a su consideración de entidad religiosa, se desprende ‘prima facie’ de sus estatutos, así como del cuerpo de doctrina aportados, y también del hecho de que la asociación es similar a otras que se encuentran debidamente inscritas en registros oficiales en países de nuestro entorno jurídico y cultural“. Al ordenar la entrada de la Iglesia de Scientology en el Registro de Entidades Religiosas, la decisión de la Audiencia se alinea con la sentencia del Tribunal Constitucional 46/2001 referida a la Libertad de Religión y el Registro de Entidades Religiosas y la sentencia del 5 de Abril 2007 del Tribunal Europeo de Derechos Humanos en relación a la Iglesia de Scientology de Moscú.
